Termination of employment for just cause requires that an employer prove it has terminated an employee’s employment on the basis of serious misconduct that goes to the heart of the parties employment contract. Proving just cause can be difficult for employers. Courts will often find a reason why an employee should receive their due. To be sure, there are exceptions, but they are exceedingly rare.

Constructive dismissal is the term used where an employee resigns in response to their employer’s conduct in breach of an important term of their employment contract or because the employer’s treatment of the employee demonstrates their intention not to be bound by the contract, making continued employment intolerable. In short, constructive dismissal is a change to a fundamental term of employment without first obtaining an employees consent.
If an employee is constructively dismissed, the employee is entitled to claim for severance pay.
